ii)The pre- Simmons v Castle column (for cases funded by pre-LASPO CFAs) has now been omitted (save that the guideline figures for mesothelioma claims are still on a pre-LASPO basis because the Act was not commenced for those cases) In previous editions, the section covering injury to reproductive organs focused primarily on the loss of fertility and reproductive capacity. The scope of this section has now been widened to capture injuries resulting in sexual dysfunction, loss of sexual function and the related psychological consequences in both sexes. For the vast majority of cases, it is likely that the above change will not make a great deal of difference. Quantum has always taken into account any acceleration in need for hearing aids, if the same can be proved.

Time will tell whether arguments will be raised in relation to cases of very low levels of loss where there is no noticeable effect on an individual, but an acceleration in need for hearing aids can be proved. The first specific references to claims arising from sexual abuse appear in the 6 th edition of the JCG, published in 2002. There are two distinct references in that edition, both of which are in the chapter for psychiatric injury.

Assessing the value of your claim at the outset can be complicated, particularly if you have multiple injuries. Practitioners across Scotland regularly use the JC Guidelines to inform and advise on the likely awards for damages in Scotland. A key element that has been missing is a specific category for abuse cases. A new category is to be welcomed and was a recommendation of the Independent Inquiry into Child Sexual Abuse. The 15th edition of the Judicial College Guidelines for the assessment of damages in personal injury cases was published on the 26th November 2019, more than two years after the previous edition.

Recently, several state bodies have carried out work into the law on personal injuries, court awards and the costs of claims arising from personal injury. These includethe Personal Injuries Commission, the Law Reform Commission as well as the Central Bank. What the Committee is required to do under the Act must, however, be distinguished from what has been done by other bodies to date. Its work is not inquisitorial in nature or designed to inform government policy. It would be entirely inappropriate and beyond the remit and power of the judiciary or the Committee to embark upon any such course. The Committee In some ways this might be considered to be a variation of section (d). If a claimant is able to prove NIHL of, say 7 dB which could be considered under section (d), then there is likely to have been an acceleration in the need for hearing aids, or there will be.An example of injury to feelings damages awarded in an abuse claim is BDA v Quirino [2015] EWHC 2974 (QB).
